BOGEYHUNTER DESKTOP - END USER LICENSE AGREEMENT

PLEASE READ THIS AGREEMENT BEFORE INSTALLING OR USING BOGEYHUNTER DESKTOP (THE
"SOFTWARE"). BY CLICKING "I AGREE", OR BY INSTALLING OR USING THE SOFTWARE, YOU
AGREE TO THIS AGREEMENT. IF YOU DO NOT AGREE, DO NOT INSTALL OR USE THE SOFTWARE.

1. LICENSE GRANT
   a. Subject to this Agreement and payment of the applicable fee, we grant you
      a non-exclusive, non-transferable license to install and use the Software
      for your own golf practice and coaching, on computers you own or control.
   b. A license key is issued for a major version of the Software (for example,
      version 1.x). It covers that major version and the patch releases we
      publish for it. A later major version (for example, 2.x) is a separate
      purchase. The version your key covers keeps working; you are never
      required to upgrade.
   c. Trial. Without a key, the Software runs as a trial for 30 days per major
      version. When the trial ends, the Software stops working until a valid
      key is entered, except that you can always export your own data.
   d. A license is for one person or one practice facility. You may not share
      your key publicly or with other people or facilities.

2. LICENSE VERIFICATION
   The license key is checked on your computer. The Software does not contact
   our servers to validate or activate the license, and stops working if the
   key is missing, invalid, or for an earlier major version.

3. RESTRICTIONS
   You may not, and may not let others: (a) copy, sell, rent, lease, lend,
   sublicense, or redistribute the Software or any key; (b) reverse engineer,
   decompile, or disassemble the Software, or attempt to extract its models,
   prompts, or data, except where the law expressly permits it despite this
   restriction; (c) remove or alter license checks or notices; (d) use the
   Software to build a competing product; or (e) use the Software unlawfully.

4. YOUR DATA AND PRIVACY
   The Software stores your profiles, swing videos, analysis, and coaching
   conversations on your computer. Coaching runs on your computer; your data is
   not sent to us or to third-party AI services. See our Privacy Policy at
   bogeyhunter.ai/privacy.html. You can export your data at any time, and the
   uninstaller asks whether to keep or delete it.

5. DOWNLOADS AND UPDATES
   The Software may download its components and AI models from our servers
   during installation or first run, and check our servers for updates. We may
   publish patch updates for your major version; when automatic updates are
   enabled they install within your major version only. New major versions are
   offered, never installed automatically.

6. AI COACHING
   Coaching feedback in the Software is generated by an AI system ("Coach
   Mulligan"). It may be inaccurate or incomplete. It is not a substitute for
   a qualified golf instructor, and it is not medical, physical therapy, or
   fitness advice. Practice within your own physical limits and stop if you
   feel pain. Swing measurements are estimates from camera video.

7. HARDWARE AND THIRD-PARTY SOFTWARE
   The Software requires a compatible Windows computer with an NVIDIA RTX
   graphics card and a supported driver, and compatible cameras. It can work
   alongside third-party products such as golf simulators and launch monitors,
   which are governed by their own terms. We do not warrant that the Software
   works with every hardware or software configuration.

8. THIRD-PARTY COMPONENTS
   The Software includes third-party components under their own licenses,
   listed in THIRD_PARTY_LICENSES.txt and in the Software's Licenses page.
   Those licenses govern those components, and nothing in this Agreement limits
   your rights under them.

9. PURCHASES AND REFUNDS
   Purchases are processed by our reseller and merchant of record, Stripe,
   through Stripe Managed Payments (shown at checkout and on receipts as "Sold
   through Link"), which also handles taxes. Because every major version
   includes a free 30-day trial to confirm the Software works with your
   computer, cameras, and simulator before you buy, purchases are final and
   non-refundable, except (a) where applicable law requires a refund, or (b)
   where a defect in the Software stops it from working on a computer that
   meets the published system requirements and we cannot fix the defect.
   Setup and configuration (camera choice and placement, USB ports and
   bandwidth, frame rates, lighting, simulator and launch-monitor settings)
   is what the trial is for and is not a defect. See
   bogeyhunter.ai/refunds.html. A refunded license is no longer licensed, and
   you must stop using the key.

10. OWNERSHIP
    The Software is licensed, not sold. We and our licensors keep all rights,
    title, and interest in the Software, including the "BogeyHunter" and
    "Coach Mulligan" names, characters, and marks.

11. DISCLAIMER OF WARRANTIES
    TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SOFTWARE IS PROVIDED "AS IS"
    AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS,
    IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR
    A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

12. LIMITATION OF LIABILITY
    TO THE MAXIMUM EXTENT PERMITTED BY LAW, AND BEYOND APPS WILL NOT BE LIABLE
    FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES,
    OR FOR LOSS OF DATA, PROFITS, OR GOODWILL, OR FOR PHYSICAL INJURY DURING
    PRACTICE OR RELIANCE ON AI COACHING, ARISING FROM THE SOFTWARE. OUR TOTAL
    LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE LICENSE
    IN THE TWELVE MONTHS BEFORE THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THESE
    LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.

13. TERMINATION
    This Agreement ends automatically if you breach it. When it ends you must
    stop using the Software and delete it. Sections 3, 4, 8, and 10 to 15
    survive termination.

14. GOVERNING LAW
    This Agreement is governed by the laws of the State of Nevada, United
    States, without regard to conflict-of-law rules. Disputes will be resolved
    in the state or federal courts located in Clark County, Nevada, and you
    consent to their jurisdiction. The United Nations Convention on Contracts
    for the International Sale of Goods does not apply.

15. GENERAL
    This Agreement, together with our Privacy Policy, is the entire agreement
    about the Software. If any part is unenforceable, the rest remains in
    effect. Our failure to enforce a term is not a waiver. You may not assign
    this Agreement; we may assign it in connection with a merger or sale of
    the business. We may update this Agreement for future versions; the
    version you accepted applies to the version you installed.
